New City Rules to Require Photo ID for All Tobacco Purchases in Milpitas
A local retail policy scheduled to take effect in October will mandate that Milpitas stores check identification for every tobacco customer regardless of age.

Store owners and shoppers in Milpitas are preparing for a new city policy that requires retailers to check identification for every customer purchasing tobacco products, regardless of their apparent age. The rule is part of a local Tobacco Retail License framework adopted by the Milpitas City Council that takes effect on October 1.
Under existing federal guidance, retailers are required to verify identification for purchasers appearing to be under 30 years old. The new municipal code goes further by removing age discretion entirely, requiring clerks to check credentials even for older adult patrons.
Supporters say uniform carding simplifies enforcement and helps keep tobacco out of the hands of minors. Meanwhile, some retailers and community members have questioned the practical burden of verifying ID for lifelong seniors and long-time adult customers.
