Acceptance of Terms

When you download or use the YupUp app or website, create or log into a YupUp account, or make a purchase through our platform, you are agreeing to follow these Terms and our Privacy Policy. If you do not agree with them, please do not use YupUp.

Eligibility

You must be at least the age of majority in your location and able to legally enter into agreements in order to use YupUp. By using our platform, you confirm that you meet these requirements.

Your Account

It’s your responsibility to keep your account information safe and private. If someone else accesses your account, you are responsible for any activity that takes place. If anything seems suspicious, please notify us right away. Each person may only create one personal account. If you provide false information or violate these Terms, YupUp may suspend or close your account.

Use of the Platform

YupUp is here for your personal use, not for reselling, copying, or scraping. You agree to use the platform only as intended, with accurate and truthful information, and to follow all applicable laws. Sharing or selling deals, QR codes, or using bots or unauthorized tech to access YupUp is not allowed.

Vendor Responsibility

All deals featured on YupUp are created, fulfilled, and managed by the independent businesses we partner with, referred to as our Vendors. While YupUp provides the platform to help you discover and purchase these deals, we do not control the quality, availability, or delivery of the goods and services offered. Each Vendor is solely responsible for fulfilling their offer and resolving any related customer service matters.

Payments and Redemptions

All purchases made through YupUp are governed by our Terms of Sale. Each deal includes a specific promotional value and must be redeemed within the terms listed. Offers are not redeemable for cash unless required by law.

Modifications

We may update these Terms at any time, and we’ll reflect the changes on this page. By continuing to use YupUp after changes go live, you’re agreeing to the updated Terms. We recommend checking back periodically to stay informed.

Intellectual Property

YupUp, our logo, and all content we create are owned by YupUp Corp. You may not copy, alter, distribute, or use any of our materials without prior written consent.

Disclaimers

YupUp is provided as-is and as-available. While we strive for accuracy, we can’t guarantee uninterrupted service or that every offer will be available exactly as listed. You use YupUp at your own risk.

Limitation of Liability

We are not liable for indirect or accidental damages that result from using YupUp or purchasing any deal on our platform. If we are found to be liable for any reason, our responsibility will not exceed the amount you paid for the specific deal in question.

Termination

YupUp may suspend or permanently disable your access to the platform at any time if we believe you’ve violated our Terms, engaged in fraud, or acted in a way that could harm our users, partners, or brand.

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to the Terms or your use of the YupUp platform will be resolved through binding arbitration in San Francisco, California. Unless your claim qualifies for small claims court. by using YupUp, you agree to submit to the personal jurisdiction and venue of San Francisco for all dispute resolution proceedings.

Messaging

By signing up for YupUp, you agree to receive recurring automated marketing and informational communications from us, which may include text messages (SMS/MMS), push notifications, and emails. These communications may be sent via automated systems to the contact information you provided when signing up or any updates you later provide. Message frequency may vary depending on your interaction with the YupUp platform. YupUp reserves the right to modify the frequency, content, or method of delivery (e.g., switching between SMS, push, or email) at any time. Message and data rates may apply for text messages. Contact your wireless provider for specific details. Your wireless provider is not liable for delayed or undelivered messages. Consent to receive marketing messages is not a condition of any purchase. Similarly, delivery of push notifications and emails may depend on your device settings, service provider, or email platform. You may opt out at any time:

• Text messages: Text "STOP" to unsubscribe. You’ll receive a confirmation message, and no further messages will be sent unless you opt in again.
• Push notifications: You can disable these through your device’s app settings.
• Emails: Click the “unsubscribe” link at the bottom of any marketing email.

Please note: You may still receive important service-related messages, such as account updates or confirmations, even if you opt out of marketing communications. If you change or transfer your phone number or email address, you agree to either opt out (by texting “STOP” or unsubscribing from emails) or notify us at support@yupup.com. Failure to do so may result in messages being sent to someone else who obtains your previous contact information.

We reserve the right to change, update, or terminate our messaging program at any time. Updates to these terms will be effective immediately upon posting. Continued use of the YupUp platform after any such changes constitutes your acceptance of the new terms.
